01Interpretation and definitions

Interpretation

Capitalised words have the meanings defined below, whether they appear in the singular or the plural.

Definitions

  • Country means the Republic of Indonesia.
  • Company (also “We” or “Us”) means PT Mella Paint & Chemicals, Komp. Green Ville Blok AW No.16, Duri Kepa, Kebon Jeruk, Jakarta Barat 11510, Indonesia.
  • Website means the Mella Paint website at mellapaint.com.
  • Quotation means a written price quotation issued by the Company for a project or a product purchase.
  • Terms means these Terms and Conditions, which form the agreement between You and the Company on the use of the Website.
  • You means the individual accessing or using the Website, or the business that individual represents.

02Acknowledgement

These Terms govern the use of the Website and apply to all visitors. By accessing or using the Website, You accept these Terms. If You do not agree, please do not use the Website.

You confirm that You are at least 18 years old, or that You are using the Website on behalf of a business You are authorised to represent.

Your use of the Website is also subject to our Privacy Policy, which explains how we collect, use and protect Your personal data.

03Website information and quotations

The Website does not sell products or services online and does not show prices. Product information, estimated installation times, minimum areas and colour samples on the Website are general descriptions and are not binding.

A working relationship with the Company is formed only through a Quotation You accept or a written contract. Specification, price, schedule, payment and warranty are set out in those documents. Where the Website and a Quotation or contract differ, the Quotation or contract prevails.

04Forms and communication

When You fill in a form or contact us on WhatsApp, by phone or by email, You agree to give accurate details and agree that we may contact You through those channels about Your request.

You may not submit forms automatically, send bulk messages or use another person’s identity. Submissions of that kind may be rejected or blocked.

05Intellectual property

The text, photographs, images and layout of the Website, and the Mella Paint and MPEX767 names and logos, belong to the Company. They may not be copied, altered or used commercially without the Company’s written permission.

Client names and logos shown on the Website belong to their respective owners.

07Restriction of access

We may restrict or block access to the Website without notice if it is used in breach of these Terms, for example through automated form submissions, attempts to interfere with the Website’s security, or bulk copying of content.

08Limitation of liability

To the extent permitted by applicable law, the Company and its suppliers are not liable for any indirect, incidental, special or consequential damages arising from the use of, or inability to use, the Website, including:

  • Loss of profits
  • Business interruption
  • Loss of data or information

The Company’s liability for products and project work, including warranty, is governed by the relevant Quotation or contract, not by these Terms.

09Website provided “as is”

The Website is provided “as is” and “as available”, without warranty of any kind. We do not warrant that:

  1. The Website will always be available without interruption or error.
  2. All information on it is accurate and current.
  3. The Website is free of viruses or harmful components.

10Governing law

These Terms are governed by and interpreted under the laws of the Republic of Indonesia. Personal data is processed in line with Law No. 27 of 2022 on Personal Data Protection, as explained in the Privacy Policy.

11Dispute resolution

If You have a complaint or dispute about the Website, please contact us first so it can be settled amicably. If no settlement is reached, the dispute will be resolved through mediation or, if necessary, before a district court in Jakarta.

12Severability and waiver

Severability

If any provision of these Terms is held unenforceable, the remaining provisions stay in full effect.

Waiver

A failure by the Company to enforce a right or provision is not a waiver of that right or provision.

13Language

These Terms are available in Indonesian and English. In case of any difference in interpretation, the Indonesian version prevails.

We may change these Terms at any time. Changes take effect when published on this page, and the date at the top of the page is updated. By continuing to use the Website after a change, You accept the updated Terms.
